A deposit of $____ is hereby made and the cash balance $_____ is due to Seller before this

balance is paid in full. The Buyer understands that once a deposit is made, it is a
commitment to buy said dog and is therefore NON-REFUNDABLE.
Seller accepts PERSONAL CHECKS for the DEPOSIT ONLY and only if there is 2 weeks for
the check to clear before puppy is picked up. All other payments should be sent to the
seller in the form of a CASHIERS CHECK, MONDEY ORDER or PAYPAL. ONLY CASH IS
ACCEPTED WHEN PICKING UP YOUR PUPPY.
IT IS HEREBY AGREED BY BOTH PARTIES THAT THE FOLLOWING CONDITIONS WILL BE
MET AND THAT NO OTHER WARRANTIES OR CONDITIONS ARE EXPRESSED AND MPLIED.
BUYER certifies that he/she is not acting as an agent for another individual in the
purchase of this dog, and will not sell this dog to any mass-producing kennel (puppy mill)
or business.
The purchaser promises to keep the dog in a proper manner. It shall not be kept
permanently in a kennel. If at any time it should be necessary for the dog to change
hands, the Breeder has prior purchase rights for a period limited to two weeks. Selling to
a third party is permissible only after prior consultation with the Breeder, whereby the
main consideration is the assurance that the dog is passed to responsible owners.
This puppy has been bred by us and has been carefully and painstakingly reared. The
parent animals where mated with aim of breeding good and healthy puppies. Seller
guarantees this dog to be free of communicable diseases as appears to the eye at the
time of sale.
Puppy buyer agrees to register the puppy with AKC (or ACA) by the deadline stated on the AKC (or ACA)
registration papers given to them.
Puppy buyer agrees that this puppy will be given adequate and proper shelter and
housed securely indoors. This dog shall not be neglected, allowed to roam free, or be
mistreated in any manner. The puppy shall receive proper veterinary care throughout its
life, receiving annual inoculations and placed on a heartworm preventative. The puppy
shall receive proper nutrition and care shall be taken to maintain its proper weight.
Buyer agrees to give the dog proper training and socialization. Buyer agrees to never sell
or surrender this dog into a dog fighting institution, testing center or shelter.
The Buyer also agrees to finish all puppy vaccines before taking their puppy out in
public, letting their puppy on public sidewalks and grasses, or letting their puppy be
touched by people outside of the family. This reduces the chance of your puppy picking
up a communicable disease such as parvo.
The Breeder Agrees:
That this puppy is in good health at the time of sale. The buyer will have 72hrs in which
to have the puppy examined by their own veterinarian. If the puppy is found to be ill by a
licensed veterinarian and is to be returned due to illness, a letter from the veterinarian is
required. This includes death or illness from any health condition deemed to be present
prior to the leaving the seller’s premises. Buyer shall assume any expenses associated
with returning the puppy to the seller. The seller will, at the seller's discretion, refund the
purchase price, return the dog to the buyer in healthy condition, OR exchange the dog
for another dog of equal value. At no time and under no circumstances will the Breeder
be responsible for any veterinary expenses incurred by the buyer.
If the puppy has a genetic defect detected by a licensed veterinarian within the first
year (guarantee ends when pup turns ONE year old) another dog of equal value
will be provided as a replacement, the choice to be determined by Seller. Buyer must
return puppy (at buyer’s expense) and puppy’s AKC (or ACA) paperwork to the Seller within 1
month of the exam that detected the defect before replacement will be made. Seller
must also have a letter from TWO separate veterinarians with their address, telephone
and the defect detected before any replacement puppy is given. If the Buyer refused to
return this puppy for a replacement puppy then this guarantee is null and void.
We cannot guarantee that your puppy will never develop any health problems, just as a
pediatrician cannot guarantee that a child will never develop any health problems in the
future. Some things are just not able to be predicted. Our parents are free of diseases,
disorders, and health problems; otherwise we would not breed them. That means our
puppies are less likely to develop problems. If anything does occur, you are required to
inform us so we can evaluate the parents and the other puppies from that litter in an
attempt to determine the cause of the ailment and to eliminate the issue from our breeding program.
Breeder does NOT GUARANTEE against COCCIDIA or GHIRDIA (typically dormant single celled parasites common in puppies) or for final adult weight, color, breeding ability,
show potential or against overbites, under bites, patella issues, hernias, trachea
issues or for undesended testicles. Seller agrees to notify buyer if they or the vet
discover any of the above problems prior to sale. By initialing, you agree that you have
read and understand what BREEDER does and does not guarantee for. X_________ (initial)
Buyer releases Seller, Clint Nowlin, and their estate from any
and all liabilities, and/or damages by fault of this dog after the time of sale. These
damages include, but are not limited to, destruction of property and/or physical damage
to any person or group of people.
This contract is made out in duplicate; the Seller and the Buyer each to receive a copy.
